1. About Clotherly

Clotherly is a fashion search and discovery platform operated in New South Wales, Australia. We display product listings supplied by our official retail partners, so you can search and compare fashion by colour, style, size, price, and shopping centre.

Clotherly does not hold stock, process payments, or interfere with retailer pricing. When you complete a purchase, you buy directly from the retailer, on their website, under their terms. By using Clotherly you agree to these terms.

2. Use of the service

You may use Clotherly for personal, non-commercial purposes. You must not:

  • Scrape, crawl, or systematically download any data from our platform, including product data and our shopping centre, store and brand listings
  • Attempt to reverse-engineer, disrupt, or interfere with the service
  • Use the service for any unlawful purpose
  • Misrepresent your identity or impersonate any person or entity

3. Product information

Product listings, prices, availability, and images are provided by our retail partners. This information may not be current and may differ from what is shown on the retailer's own site. Clotherly makes no warranty as to the accuracy, completeness, or timeliness of any product information. Always confirm pricing and availability directly with the retailer before purchasing.

4. Third-party retailers

Links from Clotherly lead to third-party retailer websites. We are not responsible for the content, accuracy, privacy practices, or terms of those websites. Any transaction you complete with a retailer is solely between you and that retailer. Clotherly is not a party to those transactions.

5. Accounts and premium subscriptions

You may create an account using email/password, or Google, Facebook, or Apple sign-in. You are responsible for maintaining the security of your account credentials, and all activity that occurs under your account. Notify us immediately at hello@clotherly.com.au if you suspect unauthorised access.

Premium subscriptions (Clotherly Pro) renew automatically unless cancelled at least 24 hours before the renewal date. Where you bought it decides who takes the money and where you cancel. Bought in the app, it is billed through Google Play or the Apple App Store, governed by that store's billing policies, and cancelled in your account settings with that store. Apple and Google both require that. Bought here on the website, it is billed by Stripe and you can cancel it at any time from your account page. Refunds follow the same route: the relevant app store handles refunds for purchases made in the app, under its own policy, and we handle refunds for subscriptions bought on the website.

6. Intellectual property

Product images, trademarks, and brand names are the property of their respective owners. Clotherly does not claim ownership of any retailer's intellectual property. The Clotherly name, logo, and platform design are owned by Clotherly. You may not reproduce or use them without prior written permission.

7. Disclaimer of warranties

Clotherly is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of viruses. To the extent permitted by applicable law, all implied warranties are excluded. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

8. Limitation of liability

To the maximum extent permitted by applicable law, Clotherly and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service or any third-party retailer. Nothing in these Terms limits any rights you may have under the Australian Consumer Law.

9. Retailer data removal

Retailers may request removal of their products, their store listings, or any other reference to their brand from Clotherly at any time by contacting hello@clotherly.com.au. We will action removal requests within a reasonable timeframe.

10. Changes to these terms

We may update these terms from time to time. Continued use of Clotherly after changes are posted constitutes your acceptance of the updated terms. We will update the "Last updated" date above when changes are made.

11. Governing law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
